Well I agree in the technical sense but get police, the district attorney/prosecutor, judge, and a jury to agree and I think you will have a really hot time. Im a man and got assaulted a separate time from my initial response when I was in college and went to a big party, drank too much and passed out, woke up to some random chick riding me.
